Getting approved with a CCJ will depend on a few things:
Date the CCJ was registered
The more recent a CCJ is, the bigger the impact it will usually have on a mortgage application.
Typically we can assist if your unsatisfied CCJ’s are over 2 years old, and you have a 10% deposit.
The Value of the CCJ
The lower the value of the CCJ, the less of an impact it is likely to have on your application, however, how much this affects the outcome differs vastly from lender to lender.
The CCJ Being Satisfied
If the CCJ has been settled in full, and was registered for less than £500 there is a possibility of us placing you with one of a few High Street lenders that will take a view on this.
A larger deposit
Having a higher deposit will always increase the possibility of being approved for a mortgage with a CCJ irrespective of the amount owed on the CCJ or the date it was registered.
In England, Wales and Northern Ireland, a court can issue a type of order called a County Court Judgement (CCJ) against you if you have failed to meet the agreed repayments on a loan.
A CCJ can be issued against individuals or companies.
If there are credit arrears creditors will have chased you up in the form of bills, reminders, calls, possibly bailiffs and then finally a formal warning letter informing that if the debt or arrears are not paid or no communication made to make arrangements to pay, then court action will follow. They will also outline what steps you can take to avoid court proceedings starting.
If ignored then a County Court claim form will be sent.
This must respond to promptly to avoid further escalation, and is advisable to provide details surrounding your financial situation, which the court will take into account when making a judgement.
This is your opportunity, if you dispute the debt, to put forward your side of the case. If you do not respond, then the court could order you to pay the amount owed in full, immediately.
The court might rule that there is a debt to pay, in which case they will send a judgement, outlining:
If the debt is paid in full right away (plus any interest and court fees), then a CCJ will not be recorded against you.
However, if it’s not the CCJ will be registered in the Register of Judgements, Orders and Fines, meaning it will also appear on a credit report
A CCJ will remain on a credit credit file for six years from the date that it was served, and will be removed automatically after this period. It will still flag up even if you pay off the CCJ in full within six months, meaning that lenders will view this when running a credit check.
Usually the date, size and amount of CCJ’s showing on your credit file coupled with the deposit or equity you have will determine the rate offered to you.
In some circumstances, yes. If you think a CCJ has been registered on your account by mistake, or unfairly, contact the three credit reference agencies; Experian, Equifax and TransUnion to remove a CCJ from your credit profile.
However, you’ll need to be able to prove that:
You paid the full amount within one month of the CCJ being issued
It has been six years since you received the CCJ
You had disputed the CCJ and it was cancelled or ‘set aside’ by the court
How much deposit required will differ considerably from lender to lender and will be based on your own personal circumstances and the type of property you are looking to purchase.
Lenders have their own criteria covering this.
The deposit can be derived from your own savings, the sale of your existing property or a family gift.
